Under Texas law, there is no separate stipulation for Assault with Family Violence. Therefore, the same provisions that define assault applies to domestic violence, which states that Assault is committed by someone when he or she:

Purposely causes bodily injury to another

Intentionally or knowingly threatens another with imminent bodily injury, including the person’s spouse

Intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative

Victim suffered serious bodily harm and/or the assault was carried out with a deadly weapon (second-degree felony) - prison sentence from 2 to 20 years, fine up to $10,000
